Welcome to Red Otter Farms, operated by Red Otter Farms Private Limited (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of our websites located at www.redotterfarms.in and www.redotterfarms.health, our online shop available at shop.redotterfarms.in and shop.redotterfarms.health, and any related applications, tools, or services (collectively, the “Platform”). By accessing, browsing, or placing an order through the Platform, you agree to be bound by these Terms. If you do not agree, you should refrain from using the Platform.

Red Otter Farms Private Limited is a company incorporated under the laws of India, having its registered office at 146/B3, Ground Floor, Shahpurjat, New Delhi – 110049, Corporate Identification Number U01100DL2019PTC350161, and GSTIN 07AAJCR6045E1ZD. The company is engaged in the cultivation, sourcing, curation, and direct-to-consumer sale of fresh produce, curated boxes, and select food and farm-related products.

You must be at least eighteen years of age and legally capable of entering into a binding contract under Indian law to use the Platform. By placing an order, you represent that all information provided by you is accurate, current, and complete.

To access certain features of the Platform, you may be required to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account. Red Otter Farms Private Limited shall not be liable for any loss or damage arising from unauthorized use of your account.

All products displayed on the Platform are subject to availability and seasonal variation. Prices are displayed in Indian Rupees and are inclusive or exclusive of applicable taxes as clearly indicated at checkout. While we take reasonable care to ensure accuracy, inadvertent errors in pricing, product descriptions, or availability may occur. In such cases, we reserve the right to cancel the affected order and issue a full refund of any amount paid.

Orders are confirmed only upon successful receipt of payment through authorized third-party payment gateways. At present, Cash on Delivery is not offered, and all orders must be prepaid at the time of checkout. By placing an order, you authorize us to collect payment for the products purchased along with applicable taxes and delivery charges.

Delivery timelines displayed on the Platform are indicative and may vary due to operational constraints, weather conditions, traffic, or other factors beyond our control. While we make reasonable efforts to deliver within estimated timelines, exact delivery times are not guaranteed. Title and risk in the products pass to the customer upon successful delivery.

Requests for order modification or cancellation must be made before harvesting, processing, or packing has commenced. Once harvesting or packing has begun, cancellation may not be possible. Detailed terms relating to cancellations, returns, and refunds are set out in our Returns and Refunds Policy, which forms an integral part of these Terms.

All intellectual property on the Platform, including but not limited to text, images, logos, trademarks, designs, and software, is the exclusive property of Red Otter Farms Private Limited or its licensors. Unauthorized reproduction, use, or distribution of any content is prohibited.

You agree to use the Platform only for lawful purposes and not to engage in any activity that disrupts the Platform’s operation, compromises its security, or violates applicable laws.

To the extent permitted by law, Red Otter Farms Private Limited shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Platform. Nothing in these Terms limits consumer rights available under the Consumer Protection Act, 2019.

You agree to indemnify and hold harmless Red Otter Farms Private Limited, its directors, officers, employees, and affiliates from any claims or liabilities arising out of your misuse of the Platform or breach of these Terms.

In accordance with the Consumer Protection (E-commerce) Rules, 2020, the Grievance Officer for the Platform is Mr. Brij Satija, President, who can be contacted at contact@redotterfarms.in or +91 93158 11181, with correspondence addressed to the registered office of the company. All grievances will be acknowledged within forty-eight hours and resolved within one month.

These Terms are governed by the laws of India, and the courts located at New Delhi shall have exclusive jurisdiction. We reserve the right to revise these Terms from time to time, and continued use of the Platform constitutes acceptance of the revised Terms.
